Contracting Guidance

Whenever the school enters into an agreement with a provider it enters into a legally binding contract. If you are authorised to enter such agreements on your school's behalf you should ensure that you understand the legal obligations involved.

Contracts come in various different forms, some may arise by simply using an order form and others may not be documented in any way at all. Contracts can involve any number of services or goods, from purchasing stationary to obtaining building works but all, irrespective of the significance of the service, are equally binding in law.

One common feature of all contracts, whatever its value or content, is that they can, and often do, lead to disputes.

Issues like the date of delivery; quantity and quality of goods; the price; the payment and ending the agreement, if not fully understood by both parties, can lead to problems which could cost your school money.

You should seek the appropriate authority before entering into any agreement and where there are any doubts or uncertainties independent legal advice should be sought.

Please ensure that care is taken when entering into agreements on behalf of your school.
